The U.S. Securities and Exchange Commission has adopted a revised quorum rule, effective October 2, 2026, that retains the standard three-commissioner threshold for official action while creating a narrower exception allowing as few as one commissioner to constitute a quorum for a particular matter when every other sitting commissioner is disqualified, a structural change that raises questions about decision-making concentration in a period of active SEC crypto rulemaking. The SEC finalized Release No. 34-106537 , amending 17 CFR 200.41, the agency’s longstanding Commission Quorum Requirement. The rule took effect October 2, 2026, per the Federal Register document 2026-20262.
