A Mississippi federal judge let two NAACP groups’ Clean Air Act lawsuit proceed, rejecting X.AI Corp. and MZX Tech LLC’s bid to dismiss allegations about unpermitted turbines serving AI data centers near Memphis. The opinion, released Friday, Oct. 30, found that the plaintiffs have standing under the Clean Air Act. The judge also ruled that the turbines do not qualify as “mobile sources” under Mississippi’s state implementation plan and rejected arguments that the law’s citizen-suit provision violates Article II or the private nondelegation doctrine.
