On November 3, 2026, the Commodity Futures Trading Commission (CFTC) issued a decision that could fundamentally reshape access to perpetual futures tied to individual stocks in the United States. The move enables regulated US exchanges to offer stock perpetuals under a framework coordinated with the Securities and Exchange Commission (SEC). The decision classifies equity perpetual contracts as security futures, placing them under joint CFTC and SEC oversight. This regulatory route uses the Commodity Futures Modernization Act of 2000 (CFMA) rather than introducing new legislation.
